TERMS OF SERVICE AGREEMENT
I. DEFINITIONS AND DESCRIPTION OF SERVICES:
1. Terms of the Agreement:
1.1. Service Agreement
"Service" means the entirety of online video game services, digital content, utilities, and related functions published, operated, and/or provided by Gamota Joint Stock Company ("Gamota") through websites, mobile applications, or other digital platforms. This includes but is not limited to video game services, user support services, etc. Any new features added to, or enhancing, the Service are subject to the terms of this Terms of Service Agreement.
The Gamota Terms of Service Agreement ("TOS") comprises the entire agreement between Gamota and the User. By clicking "Agree" during account registration, or by performing any act of accessing or using the Service, the User confirms that they have read, fully understood, and voluntarily agree to be bound by all the terms and conditions set out in this Terms of Service Agreement.
1.2. Conditions of use
The User is responsible for carefully reading and confirming agreement with all provisions of the TOS before using the Service, in order to understand the User's rights and obligations when using the Service. Once the Service has been used, the User is deemed to have fully and voluntarily agreed to all provisions of the TOS. If the User does not agree with any term of the TOS, the User has the right to stop accessing and not use Gamota's Service. Where the User is a minor, the User must obtain the consent and supervision of a parent or legal guardian before registering for and using the Service. In addition, the parent or legal guardian must agree to the entire content of this TOS. Gamota's products carry clear age ratings. The User is responsible for choosing products appropriate to their age. Gamota is not responsible for any damage arising from the User's intentional misrepresentation of their age.
The TOS does not replace any additional terms that the User has been notified of by Gamota, and it applies when using content or services from third parties. Gamota has full authority to adjust, update, or amend this agreement at any time, and any amendment will take effect once notified on Gamota's official website/application. The User may review the TOS by periodically accessing the Service or the website/application to learn of any amended content. If the User does not accept any amendment, the User may terminate the TOS. If the User continues to use the Service after an amendment has been notified, this will be deemed acceptance of all such amended content and terms.
Gamota has full authority to refuse to allow the User to access the website/application or the Services for any reason. In the event any issue arises during the User's participation in the Service and/or the website/application, Gamota's decision shall be final.
1.3. Scope of application
The TOS constitutes the entire agreement between Gamota and the User relating to the use of the Service, unless otherwise separately agreed in writing between the parties.
Where the User accesses content or services provided by a third party (such as payment gateways, infrastructure providers, or game-development partners), the User may be required to comply with additional, separate terms of such parties. Gamota is not responsible for any claim or damage arising from the relationship between the User and a third party that is outside Gamota's direct control.

2.8. II. REGULATIONS ON REGISTRATION, LOGIN, PROTECTION, AND ACCOUNT HANDLING
1. Account registration
1.1. Registration
Users must register an Appota ID Account by fully and accurately completing the registration form available on Gamota's official Service website/application.
Users must provide basic information that is authentic, accurate, and complete while using the Service, and must keep such information up to date whenever it changes, is amended, or is replaced, including but not limited to the following information:
- Full name;
- Date of birth;
- Mobile phone number (verified with the telecom carrier);
- Email address (if any).
(Gamota may require additional information as prescribed by law and for identity verification purposes when necessary.)
Where the account holder is under 16 years of age, the User's parent or legal guardian must use their own personal information to register the account and is responsible for supervising and managing the content and playtime of that User.
The User confirms and undertakes that:
- The registration information is accurate and truthful, and the User is solely responsible before the law for the information provided;
- The User will not use false information or another person's information to register an account;
- The User accepts the entire terms and content of the Gamota Terms of Service Agreement before using the Service.
The User is solely responsible for the accuracy of, and ownership rights over, the phone number used for verification. The Company does not resolve account disputes if the verification phone number does not belong to the User's lawful ownership.
Any inaccurate, non-genuine information, or information provided for any other fraudulent purpose shall be considered a breach of these terms. Gamota reserves the right to refuse to provide the Service; to refuse to accept and resolve complaints related to such an account; and may temporarily suspend or permanently delete the account without prior notice if dishonest registration information is discovered.
Details on how Gamota collects, uses, stores, and protects Users' personal data, as well as Users' rights as data subjects, are set out in Gamota's Personal Data Protection Policy — an integral part of this Terms of Service Agreement.
1.2. Rules on naming user accounts
When beginning to use the game service, the User will log in using their registered Account. The User must then proceed to create a character and select a game server to be identified within the game. The User is fully responsible for all activities carried out through their account. The User must comply with the following principles, including but not limited to, when naming an account, character, guild, etc.:
- Account names, character names, or guild names (if any), etc. must not contain content related to the organizations, government, beliefs, or religions of the Socialist Republic of Vietnam.

- Names or icons/avatars must not contain content that offends or provokes others in any form.
- No name may be set that goes against Vietnamese cultural traditions and social ethics.
If a User violates these rules, their character and account will be deleted. In more serious cases, Gamota reserves the right to lock the violator's account and will decline any claim for compensation in such cases.
1.3. Age requirements for account holders
- Video games for adults (18 years of age and older, marked 18+) are games that contain no pornographic activities, images, sounds, language, or dialogue; for games with combat/confrontation elements, close-up images of weapons and characters simulating real people may be used.

- Video games for all ages (marked 00+) are games in animated/cartoon form; with no armed combat activities; no ghostly, horror, or violent images or sounds; and no activities, sounds, language, dialogue, or images of characters that are scantily dressed or pornographic, or close-up shots drawing attention to sensitive body parts.
Gamota classifies the age rating of each Game it publishes in accordance with Vietnamese law and the approval decisions of the competent State authority. Recommended age ratings will be clearly displayed on the game interface, application, and Gamota's official information channels when providing the Service. The User is responsible for noting and complying with age requirements and only participating in Services suitable for their age.
1.4. Account verification
To register a valid account, the User must verify their account using a mobile phone number that is lawfully active in Vietnam.
For the purpose of complying with the law and protecting Users, Gamota implements technical measures to record and verify Users' account information. The User undertakes and warrants that the information they provide is accurate, truthful, and genuinely their own. To the maximum extent permitted by law, Gamota is exempted from all liability (including joint liability) for any loss, damage, or consequence arising from the User intentionally providing false information, using another person's information, or applying fraudulent methods to bypass Gamota's system. Where a violation is detected, Gamota reserves the right to refuse to resolve any complaint or dispute relating to ownership of the account if the registration information does not match the actual information of the person making the complaint; and/or to immediately suspend or terminate the provision of the Service to the User's account without any compensation.
2. Login
The User will use the account they successfully registered to log in, access, and use the Service.
For each account, the User will have one password to log in and access all services using that account.
The User is solely responsible for absolutely securing their login information, password, and other authentication methods related to their account; and undertakes to apply necessary security measures to prevent unauthorized access by third parties. All activities carried out through the User's registered account shall be deemed the actions of the account owner themselves. The User must immediately notify Gamota through official support channels upon discovering or suspecting that their account has been compromised, that information has been leaked, or that there has been any unauthorized access. To the maximum extent permitted by law, Gamota is exempted from all liability for any damage, loss, or data loss arising from an account being compromised due to the User's own fault, negligence, or breach of their security obligations. Gamota reserves the right to refuse to accept or resolve any complaint or dispute relating to an account if the User fails to provide sufficient information or documentation proving lawful rights of use over that account in accordance with Gamota's verification process.
Where the User chooses to log in and use the Service via a third-party account such as Google, Apple, etc. ("Linked Account"), the User hereby voluntarily agrees and permits the provider of such Linked Account to share certain personal data of the User, including but not limited to name, email address, avatar, and user ID, with Gamota. Gamota commits that the receipt, management, storage, and processing of such Personal Data of the User will comply with the provisions of the Personal Data Protection Policy and applicable law.
However, at any time, the User has the right to unlink the Linked Account or request the deletion of login information and personal data related to the Linked Account from Gamota's system. To exercise this right, the User may proactively use the features integrated into the Service application, or through our account management link at https://id.gamota.com.
3. Account protection
Account registration information includes phone number, full name, date of birth, email (if any), and password.
After successfully registering an account, the User shall maintain their account information or update it by accessing https://id.gamota.com/profile.
All account-protection registration information (including identification information, phone number, email, or other security data recorded by the system) is the sole and highest-legal-value basis for Gamota to determine the lawful owner of the account. Gamota will only accept, verify, and support the resolution of complaints or disputes relating to an account when the User provides complete, accurate, and matching authentication information as registered above. Where the User is unable to provide valid verification information, or the information provided conflicts with or differs from the data stored in the system, Gamota reserves the right to immediately refuse support. This measure is intended to protect the assets and interests of the lawful account holder.
In the event of a complex dispute between two or more parties simultaneously claiming the right to use one account, after verification measures have been applied but the matter cannot be resolved, Gamota reserves the right to freeze (lock) the disputed account, and Gamota's decision shall be final for application and/or shall remain in effect until a legally binding ruling is issued by the competent State authority.
4. Account status and handling
The User's account is managed under the following statuses to ensure system safety and compliance with the law:
4.1. Active account: An account that has completed registration and valid verification. The User has the right to access and fully use the features and services provided by Gamota.

- The User has not provided sufficient or accurate identification/verification information as required by Gamota or applicable law.
- During the suspension period, the User cannot access or use the service until the account is restored.
4.3. Permanent account lock: Gamota will apply this in cases including but not limited to:
- The User commits a serious violation or repeated violations;
- There is fraudulent conduct or abuse of the service causing damage to Gamota or a third party.
- When an account is permanently locked, all of the User's rights to use the service will be terminated.
4.4. Account cancellation: An account may be cancelled in the following cases:
- At the User's request; or
- By Gamota's decision in accordance with applicable law and policy; or
- Where the User withdraws consent to the processing of their personal data, resulting in the service no longer being able to be provided.
Once cancelled, the account will be permanently closed, and the User will no longer be able to log in to or use this account for any other product or service published by Gamota. All virtual currency, virtual items, game progress, and benefits associated with that account will be cancelled without any refund or compensation in any form. The User's identifying personal data will be deleted or anonymized/encrypted from the system, except for data required to be retained for a certain period under applicable law.
4.5. Account restoration:
The User may contact Gamota and provide the necessary identification/verification information to have a temporarily suspended account considered for restoration. Gamota reserves the right to refuse restoration where the information provided is incomplete or inaccurate, or where the User is determined to have committed an unrecoverable violation.

- To support the User in creating, managing, and using their account. Gamota is responsible for receiving and handling complaints related to accounts and the use of the Service. The process, timeframe for receipt, and response plan will be carried out in accordance with the Complaint and Dispute Resolution Regulations for each type of incident.
- When the User requests technical support or resolution of an error arising from the game, Gamota will guide the User through remedial steps via the Customer Support (CSKH) system.
3. Personal Data Protection Policy
All activities of collecting, storing, processing, sharing, and protecting the User's personal data are carried out strictly in accordance with the Personal Data Protection Policy issued and published by Gamota from time to time. - Removing copyright or intellectual property information from the products/services.
- Copying, editing, adding, removing, or altering features or the operational effectiveness of the products/services with respect to data generated and stored at any point during operation, or interactive data between the server and the User during the operation of the products/services, and system data necessary for operating the products/services, etc.; or other actions on the system and data without Gamota's written permission or authorization.
- Creating websites similar to intellectual property content owned by Gamota or which Gamota is exclusively authorized to use or publish.
4.3. Acts related to using the products/services for profiteering
- Unauthorized use of another player's account or password.
- Buying, selling, or exchanging items or virtual units between players in exchange for cash or other things of value.
- Undermining fairness with other players by intentionally or unintentionally exploiting bugs or shortcomings in the game's scenario and design to cheat; or using other software/applications to interfere with the game; or other actions to gain an advantage in gameplay contrary to the product's regulations.

- Customer support page: https://support.gamota.com/tickets.php
- Zalo OA GAMOTA
- Gamota Fanpage: https://www.facebook.com/nph.gamota
5.2. Resolution timeframe: Gamota commits to verify and respond with the results of the complaint resolution within a maximum of 10 (ten) working days from the date of receiving complete and valid records/information from the complainant. For matters of a complex nature requiring coordination with competent authorities, the time may be longer, and Gamota will notify the User in advance.
5.3. Final decision-making authority: In all cases of disputes between players, or between a player and Gamota, the data stored on Gamota's system shall be the sole legal basis for determining and issuing the final resolution decision.
IV. Transaction and payment support
1. Receiving process
When an issue arises relating to a top-up/payment into the Service (money deducted from a bank account/e-wallet but not recorded in the Service, incorrect top-up amount, etc.), the User is obligated to immediately notify Gamota's Customer Support department and provide valid documentation including: Transaction ID, payment invoice, screenshot of the bank/e-wallet deduction, and other information as requested by Gamota to facilitate the investigation.
Gamota only accepts payment transactions made through Gamota's payment channels or payment channels provided by Gamota's partners that are introduced and published within the product/service application and/or on the product/service's homepage. Gamota will not be liable to the User in cases where the User makes payment through other payment channels, and such transactions will be considered invalid. Gamota reserves the right to refuse, recover, or deduct virtual units, and in certain serious cases, Gamota reserves the right to temporarily lock or stop providing service to violating accounts.
2. Receiving timeframe
After a successful transaction, if the User's account/game character has not received the service within 24 hours from the time of successful payment, please contact Gamota through the following methods for support:
- Customer Support Hotline 19006855 (from 8:00 AM to 10:00 PM daily)
- Submit an error report through the error reporting system at: https://support.gamota.com/tickets.php
- Submit an error report to Zalo OA GAMOTA
- Submit an error report to the Gamota Fanpage - Payment Support at: https://www.facebook.com/GamotaHTTT
After the above deadline, if no response is received from the User, the related transactions will be deemed to have been successfully completed, and Gamota shall be fully exempted from any legal liability arising therefrom.
3. Processing timeframe
Within ten (10) working days from the date of receiving complete and valid information required for the investigation from the User, Gamota will conduct the verification and notify the User of the processing result.
For transactions of a complex nature, or transactions that have been completed and recorded on the system but subsequently become disputed, the processing time may be extended but shall not exceed forty-five (45) working days (or another period as specified by the linked bank/payment gateway). Gamota will notify the User of any extension of this time.
4. Handling principles
Where the investigation result determines that the error lies with Gamota's system, Gamota will apply remedial measures for the User within the processing timeframe stated above. Where the error is determined to be caused by a third-party system (bank, payment gateway), Gamota will coordinate with and urge the third party to resolve the matter promptly in order to protect the User's legitimate rights and interests.
Gamota is exempted from liability in the following cases:
- The error did not arise from Gamota's fault.
- The User reports the error/incident beyond the timeframe prescribed by this TOS.
- Gamota's system was not functioning properly and the User "was aware" of this at the time of making the transaction.
- Errors caused by internet connection issues, connection errors, fiber-optic cable breaks, network outages, etc. — transmission errors that Gamota is unable to control.
- Due to fund-holding policies from the bank, transaction screening policies from the banking system, the User's account, or the connection between Gamota and the bank chosen by the User for payment.
Gamota strictly prohibits any act of exploiting system errors to profiteer from transactions, using stolen bank cards/accounts, or making invalid refund/chargeback requests after having used the Service. Where a violation is detected, Gamota reserves the right to permanently lock the game account, recover all items obtained from the fraudulent transaction, and refer the case file to the competent authority for investigation and handling in accordance with the law.
5. Refund and cancellation policy
Gamota allows the User to cancel a transaction within 24 hours from the time of successful payment if the User has not yet received the service.
Gamota does NOT accept requests to cancel or refund a transaction in the following cases:
- The User notifies the transaction cancellation beyond the time limit specified above (after 24 hours from the time of successful payment).
- The User only notifies the transaction cancellation by phone and subsequently does not send an email with supporting documentation requesting the cancellation.
- The User has used part or all of the GoG or virtual units that were topped up.
- Complaints related to account issues such as account disputes (due to buying/selling, transfer, shared use, etc.) or transactions currently under complaint or dispute (card fraud, chargeback) — in such cases, Gamota reserves the right to temporarily lock the account until the complaint is fully resolved.
- Complaints related to top-up transactions into the game (via game cards/bank cards) — Gamota only accepts investigation of transactions within the month in which the transaction occurred, and the complaint for that transaction must be submitted before the last day of that month. Complaints about top-up transactions submitted beyond this time limit will not be accepted by Gamota.
Gamota is exempted from compensation liability if the error arises from the user's internet connection, fund-screening/holding policies from the bank/payment gateway, or force majeure events.
V. Device access permissions and processing of image, audio, and augmented reality (AR) data
1. Principles for requesting access permissions
In the course of providing Gamota's services, Gamota may request that the User grant certain access permissions to system features on their devices. The User has full discretion to consent to or decline these requests. Declining to grant permission may render certain auxiliary features unavailable, but this is committed not to affect access to, or the experience of, the Service's core functions.
2. Scope and purpose of device data collection
With the User's consent, Gamota will access the following permissions for the purpose of optimizing the Service experience:
- Camera & Photo Album: Used for QR code scanning, taking profile photos, saving screenshots, or uploading images to the interactive system.
- Microphone: Used for voice chat features, direct voice calls, or participating in in-game livestream broadcasts.
- Location: Used for the feature of displaying and searching for nearby players (if supported by the game feature).
3. Permission revocation mechanism and effect
Users may proactively turn off or reconfigure these access permissions at any time in their device's system settings (iOS/Android). Disabling a permission is equivalent to withdrawing consent to provide such data to Gamota; however, this will not affect the lawfulness of data processing activities carried out before the time of revocation.
4. Special provisions
When a User uses a device that supports depth-sensing cameras (such as an iOS device with TrueDepth capability, or equivalent Android devices) and consents to enable the camera to experience AR features, Gamota will receive a small amount of facial expression characteristic data in order to map (synchronize) expressions onto the in-game virtual character.
Information security commitment: Gamota confirms that it does not access or collect any core biometric identification information (including Face ID) from the device. All expression data received via the TrueDepth API is temporary in nature, cannot identify any individual, will be immediately deleted from temporary memory, and will not be stored in any form (including cache or cloud storage); sharing this data with any third party is strictly prohibited.
Where a User only projects a virtual character or virtual setting onto real space through the camera without pressing the save/capture button, Gamota does not collect any image information from the User's device whatsoever.
